1 Percent Hoops LLC, 1percentathletes.com and all subsidiaries or affiliated brands (hereinafter referred to as "1 Percent Athletes", "1percentathletes.com", "We", "Us" or "Our") stand behind all of our products and your satisfaction is very important to us. All purchases made from us (including all related website properties, sales over the phone, and live event on-site purchases) are covered by the following policies.

General

Usage of Offers/Coupons. Offers and coupons cannot be combined unless explicitly mentioned otherwise. Each coupon is valid only during the specified promotional period as advertised. Prices may be subject to change without prior notice. Please note that gift cards are non-refundable.

Privacy Policy

Please review our Privacy Policy, which also governs your visit to our website and any purchases made on our website.

No Guarantee of Results

Please be aware that we do not provide any guarantee of results or offer legal advice. Athletics and any investment made inherently involve risks and require significant effort. We strongly advise consulting with your own professionals, such as legal or financial advisors, before making any investment decisions. Testimonials showcasing our success or the success of our athletes should not be considered as common, typical, or expected outcomes. It is important to understand that achieving your goals in any investment requires education, determination, and diligence.

The services offered by 1 Percent Athletes aim to connect the Student-Athlete with the best collegiate opportunities. 1 Percent Athletes does not guarantee or promise that the client will receive a scholarship or grant. The client shall not hold 1 Percent Athletes responsible for any decisions, actions, or other matters made or taken by any college or university regarding recruiting, scholarships, or grants, as these decisions and actions are solely the responsibility of the respective colleges and universities.

IN COMPLIANCE WITH NCAA AND NAIA RULES, 1 PERCENT ATHLETES DOES NOT INTEND FOR ANY OF THE SERVICES TO BE CONSTRUED AS AN ATTEMPT OR PROMISE TO PLACE THE STUDENT-ATHLETE WITH A SPECIFIC COLLEGE OR UNIVERSITY. ADDITIONALLY, THERE IS NO GUARANTEE OF ANY SCHOLARSHIP OR GRANT OFFER, NOR ASSURANCE THAT A COLLEGE, UNIVERSITY, COACH, OR ATHLETIC DEPARTMENT WILL REVIEW THE RECRUITING PROFILE OR ANY OTHER MATERIALS OR INFORMATION RELATED TO THE STUDENT-ATHLETE.

All online purchases

Non-Refundable Products. You acknowledge and agree that all online products, courses, subscriptions, merchandise, services, or books are non-refundable. It is understood that all dues and/or fees are non-refundable, except when explicitly specified in this Agreement. You also acknowledge that these fees are earned in full upon payment.

Payment Related Terms

Notice Waiver. You agree to waive the right to receive written notice regarding any increases in charges for additional products and services purchased from 1 Percent Athletes or for any dues and fees collected by 1 Percent Athletes through transactions, including the resubmission of declined or returned transactions during or after the termination of your 1 Percent Athletes Membership.

Processing of Dues and Fees. 1 Percent Athletes reserves the right to process dues and fees together in a single transaction if they are due and payable.

Independent of Usage

The obligation to pay dues and fees is not dependent on your usage, availability of, or access to the Services, even if access is limited or restricted as described in this agreement. Your non-access or non-use of the Services does not entitle you to a refund of any prepaid dues and fees.

Payment by Third Party

If 1 Percent Athletes accepts payment for your financial obligations from a third party, such as a parent, guardian, employer, or insurer, it does not relieve you of your responsibility for these financial obligations. In the event that the third party stops making payments, you understand that you are still liable for the full amount, including any payment-related fees.

Unpaid Dues and Fees. In the event of suspension or delinquency leading to the termination of your 1 Percent Athletes Membership due to nonpayment, you acknowledge that your obligations and responsibilities under this agreement and your membership remain in effect. You are still responsible for paying all dues, fees, and other financial obligations to 1 Percent Athletes. Furthermore, if you fail to make timely payments, you will be responsible for all collection costs incurred by 1 Percent Athletes, including attorney fees.

Third-Party Software and Extension Training:

Some tools provided on the 1 Percent Athletes platform include trainings on third-party software or extensions that are compatible with our tools and products. These trainings are designed to help you make the most of your recruiting experience; however, please note that we do not own or control these third-party software or extensions, and we cannot guarantee their functionality, usability, or continued support. By purchasing a membership on our site, you understand that you are purchasing training on how to use these third-party resources—not the rights to use the software itself or any guarantee regarding their performance, usability, or availability.

Payment and Subscription Terms:

By becoming a member of 1 Percent Athletes, you agree to pay the applicable fees according to the selected membership plan. These fees will be clearly communicated during the sign-up process, and you will be charged accordingly. Please note that membership fees are non-refundable unless otherwise stated.

Please be aware that payment plans and subscriptions are different: if you are paying monthly to cover a one-time investment, you are liable for all payments until the total amount due is paid.

Please note that 1 Percent Athletes no longer offers membership subscriptions. However, if your existing membership operates on a subscription basis, it will automatically renew according to the selected billing cycle (monthly, quarterly, annually, ect.). By providing your payment information, you authorize us to charge your designated payment method for the upcoming renewal period. If you intend to terminate your membership, you must cancel 3 days before the next billing cycle commences by calling 404-291-9809.

Additionally, there will be a 14-day grace period for any missed payment, during which you will still have access to your account. Your selected payment method will be charged daily during the grace period until the outstanding payment for your membership is received. If the payment is not processed within the 14-day grace period, your account will be terminated.

Membership Cancellation

Please note that 1 Percent Athletes no longer offers membership subscriptions. To cancel your existing membership with 1 Percent Athletes (this does not apply to any payment plans covering a one-time investment or to one-time payments), you must provide confirmation via phone call. Cancellation requests submitted via email or text message will not be accepted. To initiate the cancellation process, please call us at 404-291-9809 and speak directly with a representative.

By contacting us via phone, we can confirm your identity, address any concerns or questions you may have, and ensure that your cancellation request is handled promptly and accurately. We are committed to providing you with exceptional customer service throughout the cancellation process.

Payment Plans

If a product or service is purchased utilizing a monthly payment plan to cover the total amount of a one-time investment, the customer is responsible for 100% of the agreed-upon payments equaling the original purchase price of the product and/or service. If any payments are not received within the 14-day grace period, the entire purchase is void, and the payments made up to that point are forfeited and will not be refunded. Access to any digital product or platform will be removed.

Please be aware that if the full amount due is not paid, you risk your balance being sent to collections. 1 Percent Athletes prioritizes our clients' success and believes in fulfilling commitments. We dedicate significant man hours to ensure your recruitment success. We will fulfill our commitment to do our very best to get you or your athlete recruited. In turn, it is your responsibility to fulfill your commitment to pay the entirety of the investment agreed upon.

Special Promotions

The 1 Percent Athletes may, at its sole discretion, occasionally offer special promotions or discounts related to 1 Percent Athletes Memberships. However, these promotions will not automatically apply to your membership or these terms unless they are specifically made available to you or one of your members. If you are eligible for a promotion, the specific details and terms will be provided in the materials that describe the offer or during the registration process. Please keep in mind that promotions offering free trials are limited to one per household. If you receive a promotional offer that grants you a free trial without requiring a paid 1 Percent Athletes Membership, your access to the Services will automatically expire at the end of the free trial period without any additional notice or obligations. If your promotional offer includes a free trial in combination with a paid membership, your membership dues billing date will be scheduled upon the expiration of the applicable trial period. At that point, we (or one of our coaches) will initiate recurring billing on your chosen monthly payment method, in accordance with these terms.

It is important to note that if the terms of your promotional offer expressly allow you to cancel your 1 Percent Athletes Membership before the end of your trial period, you must cancel your membership in a timely manner before the trial period expires. Failure to do so will result in being charged for the 1 Percent Athletes Membership starting from your next billing date. Instructions for canceling your membership can be found above under "Membership Cancellations". Please be aware that you will not receive a notice from us indicating the end of your trial or the commencement of the paid portion of your 1 Percent Athletes Membership. Additionally, we reserve the right to modify or terminate trials at any time, at our sole discretion and without any prior notice.

Digital Download Products & Digital Video Training Access

Refunds are not available for any digital products. Your purchase grants you access to the online training platform for the specified duration as mentioned in the product description. If you encounter any difficulties accessing the digital content you have purchased, please reach out to our Customer Support at 404-291-9809 between 12 PM and 5 PM CST, Monday through Friday. We will promptly address and resolve any issues you may have. Please note that purchasing a training module from 1 Percent Athletes does not give you permission to share, reproduce, or resell the product in any manner.

Promotions

While promotion to college coaches is included as part of our packages, it is important to understand that the extent and duration of promotions are solely at the discretion of 1 Percent Athletes. Any lack of promotion, whether in terms of frequency, duration, or method, does not entitle the customer to any refund or legal action.

Please be aware that the customer's payment grants them access to our platform, but it does not guarantee a specific length or amount of promotion. The specifics of promotion-related activities are not explicitly outlined in our terms of service and are at the full discretion of 1 Percent Athletes.

Twitter Campaign (Now Known As "X")

Within our package, we include the promotion of athletes through our Twitter campaign (now known as "X"). However, it is essential to understand that the execution and duration of this campaign are solely at the discretion of 1 Percent Athletes. The length of the Twitter campaign, now known as "X," will be determined solely by 1 Percent Athletes. Once a post is made or content is reposted by 1 Percent Athletes for the athlete or any platform used to promote them, the Twitter campaign (now known as "X") is considered officially provided.

In our terms, a Twitter campaign (now known as "X") is defined as any post from 1 Percent Athletes or repost of their content from our Twitter profile (now known as "X Profile"), or any page that promotes the respective athlete.

Please note that despite the number of posts or reposts we conduct for an athlete or any page promoting them, the Twitter campaign (now known as "X") will be considered complete once the aforementioned conditions are met.

PERSONAL INFORMATION NOTICE AND CONSENT
Personal Information. Client understands and acknowledges that 1 Percent Athletes will gather all personal information regarding the Client and deliver such information to third parties in connection with this Agreement, the Services, and other uses as described in 1 Percent Athletes’ Privacy Policy. Such information may include, but is not limited to, the Student-Athlete’s full name, home address, email address, telephone number, academic and athletic information, and any other information that will allow third parties to contact and evaluate the Student-Athlete.

Consent and Release. By entering into this Agreement, Client expressly consents to the collection, disclosure, and distribution of all such information to third parties, including colleges and universities, in connection with this Agreement, the Services, and other uses as described in 1 Percent Athletes’ Privacy Policy. Client also consents to and grants 1 Percent Athletes the right to use, reproduce, distribute, create derivative works from, publicly display, publicly perform, and share with third parties the Student-Athlete’s voice, biographical information, appearance, likeness, form, image, videos, and photographs (“Likeness”). Client releases and discharges 1 Percent Athletes, its assigns, and designees (including any agency, client, broadcaster, periodical, website, or other publication) from any and all liability for damages arising from the use of such images or Likeness in any manner or media. Client waives any and all claims and causes of action for damages related to the use of such Likeness, including but not limited to unauthorized use of the Student-Athlete’s Likeness, character, or persona, violation of the Student-Athlete’s right of publicity or privacy, and for copyright or moral rights infringement or defamation.

Promotion to College Coaches

Promoting athletes to college coaches includes any posts, emails, promotions, texts, or reposting of the athlete's highlights. It is crucial to understand that promotion to college coaches is not guaranteed as a part of our package. While it is a fundamental aspect of our services, we reserve the right to withhold promotion at our sole discretion if we determine it may not benefit the athlete or align with our brand image.

Furthermore, success in recruitment heavily depends on the athlete's proactive engagement with college coaches. While we strive to facilitate connections, the athlete's initiative in contacting coaches directly significantly impacts their recruitment journey.

Additionally, the frequency and manner of athlete promotion, as well as the selection of coaches contacted, are at the sole discretion of 1 Percent Athletes. We will make every effort to optimize promotion strategies to enhance recruitment prospects, but specific outcomes cannot be guaranteed.

It is also essential that the promotion form within your member's area is accurately completed for promotion activities to commence. Any inaccuracies in the provided information may result in a delay or inability to promote the athlete effectively.

When you make a purchase of an item, product, or event from this website, you acknowledge and accept the terms and conditions outlined in this Policy, along with the Privacy Policy. It is essential to comprehend and agree to these Policies before proceeding with any transactions or purchases. If you do not agree to these Policies, please refrain from purchasing anything or engaging in any transactions with us.
